3. Service Access and Membership

5. Intellectual Property Rights

• License to You: We grant you a limited, non-exclusive, non-transferable license to access and use the Service as permitted by these ToS.

6. Subscriptions, Billing, and Payments

• Pricing: All prices are subject to change. Any changes will be communicated to you in advance.
• Billing Cycle: Subscription fees will be charged to your chosen payment method on a recurring basis.
• Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period, and no refund will be provided for any unused portion of the subscription term. Submit cancellation request by email to admin@trakselrs.com
• Refunds: Except where required by law, all payments are non-refundable.

AI Music Creators and Uploaders

This section applies to any user uploading music generated or assisted by Artificial Intelligence (AI) to the Service.

A. Originality Requirement

AI music creators and uploaders are strictly prohibited from using, sampling, remixing, editing, or incorporating any pre-existing, non-original copyrighted works of other artists, musicians, or composers in their submissions.

• Permitted Use: You may only upload AI-generated musical compositions that are entirely original and do not rely on or derive from any material protected by third-party intellectual property rights.
• Attestation: By uploading AI-generated music, you warrant that it is an original creation and does not infringe upon the intellectual property of any third party, specifically excluding the use of other artists’ specific works in a derivative capacity (e.g., remixes, edits, vocal separation, or direct instrumental sampling).

B. Enforcement

Failure to comply with these originality requirements, particularly the unauthorized use of other artists’ protected works, may result in:

1. Immediate removal of the offending content.
2. Suspension or termination of your account.
3. Reporting to relevant copyright holders.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the ToS. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL TRAKSELRS, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

10. Governing Law and Dispute Resolution
